Nxtscaleup Agency: Cancellation Policy
This Cancellation Policy outlines the terms and conditions for the cancellation of marketing services provided by Nxtscaleup (“Agency”). By engaging our services, you (“Client”) agree to adhere to this policy.
1. Cancellation by the Client:
- Written Notice: All cancellations must be submitted in writing via email to hello@nxtscaleup.com. Verbal cancellations will not be accepted.
- Notice Period:
- For ongoing monthly retainer services, the Client must provide 30 days’ written notice prior to the next billing cycle.
- For project-based services, the cancellation notice period will be specified in the individual project agreement. If no specific period is stated, 14 days’ notice is required.
- For campaigns with pre-paid ad spend, the remaining ad spend minus any fees or costs incurred by the agency is refundable. Any agency management fees associated with the campaign are non-refundable.
Cancellation Fees:
- If the Client cancels within the notice period, they will be responsible for payment of all services rendered up to the effective date of cancellation.
- If the Client cancels outside of the required notice period, they may be subject to a cancellation fee, as specified in the service agreement or proposal, or a fee that reflects work done and costs incurred by the agency.
- For work that has been completed, or in process, the client is responsible for paying for that work.
Refunds:
- Refunds, if applicable, will be processed within 14 business days of the effective cancellation date.
- Refunds will be issued using the original payment method unless otherwise agreed upon.
2. Cancellation by the Agency:
- Reasons for Cancellation: The Agency reserves the right to cancel services under the following circumstances:
- Non-payment of invoices.
- Breach of the Terms and Conditions.
- Failure of the Client to provide necessary information or materials.
- Unethical or illegal activities by the Client.
- Circumstances that make the agency unable to complete the agreed upon work.
- Notice of Cancellation: The Agency will provide the Client with written notice of cancellation, except in cases of immediate termination due to breach of terms or illegal activities.
- Client Responsibilities: Upon cancellation by the Agency, the Client will be responsible for payment of all services rendered up to the effective date of cancellation.
- Refunds: If the Agency cancels the agreement, and the client has prepaid for work that has not been completed, the agency will provide a refund for the work that was not completed.
3. Effect of Cancellation:
- Upon cancellation, all services will cease on the effective cancellation date.
- The Client will be responsible for any outstanding payments for services rendered.

4. Dispute Resolution:
Any disputes arising from this Cancellation Policy shall be resolved through good faith negotiations. If negotiations fail, the dispute shall be resolved through [Mediation/Arbitration/Litigation] in UAE.
5. Amendments:
- This Cancellation Policy may be amended by the Agency with written notice to the Client.
